29. Governing Law and Jurisdiction
These Terms and any dispute arising out of or relating to them shall be governed by and construed in accordance with the laws of India.
Subject to any mandatory consumer protection laws that cannot legally be excluded or limited, the courts of Goa, India shall have exclusive jurisdiction over any dispute arising from or relating to these Terms or any Programme offered by Parimukti.
Nothing in these Terms is intended to deprive participants of any mandatory consumer rights that may apply under the laws of their country of habitual residence where such rights cannot lawfully be excluded.
30. Electronic Acceptance
Participants acknowledge and agree that:
- ticking the acceptance box during the online booking process;
- submitting an online booking;
- paying a deposit or Programme fee; or
- attending a Programme,
constitutes electronic acceptance of these Terms and has the same legal force and effect as a handwritten signature.
Participants are responsible for ensuring they have read these Terms before completing a booking.
31. Website Information
Parimukti makes every reasonable effort to ensure that information published on its website, social media channels, brochures, and promotional materials is accurate at the time of publication.
However, occasional errors or changes may occur.
Parimukti reserves the right to correct typographical errors, pricing errors, scheduling inaccuracies, and other inadvertent mistakes without liability.
Photographs shown on the website are intended to represent the general style and atmosphere of Programmes and venues. Accommodation, furnishings, instructors, meals, activities, and facilities may vary between Programmes.
No statement made in advertising or promotional material shall constitute a contractual guarantee unless expressly incorporated into these Terms or confirmed in writing.
32. Independent Contractors
Accommodation providers, transportation companies, activity operators, guides, caterers, and other third-party service providers engaged in connection with a Programme operate independently of Parimukti.
Except where required by law, Parimukti is not responsible for the acts, omissions, negligence, insolvency, or performance of independent third-party providers.
33. Entire Agreement
These Terms, together with the following documents:
- Cancellation & Transfer Policy;
- Medical Indemnity Form;
- Privacy Policy;
- Cookie Policy;
- Code of Conduct;
- Copyright, Certification & Brand Usage Policy; and
- Website Disclaimer,
constitute the entire agreement between Parimukti and the participant.
They supersede all previous discussions, negotiations, representations, marketing statements, or understandings relating to the Programme.
34. Severability
If any provision of these Terms is found by a court or other competent authority to be invalid, illegal, or unenforceable, that provision shall be interpreted to the minimum extent necessary to make it enforceable.
If modification is not possible, the provision shall be severed.
The remaining provisions shall remain in full force and effect.
35. No Waiver
A failure or delay by Parimukti to exercise any right or remedy under these Terms shall not constitute a waiver of that right.
Any waiver must be in writing and signed by an authorised representative of Parimukti.
A waiver on one occasion shall not operate as a waiver on any future occasion.
36. Amendments
Parimukti reserves the right to update or amend these Terms from time to time.
Updated Terms will become effective upon publication on the Parimukti website unless a later effective date is specified.
The version in effect on the date a participant completes their booking shall govern that booking unless the participant expressly agrees to a later version.
37. Survival
Any provision of these Terms that by its nature is intended to survive the completion, cancellation, or termination of a Programme shall continue in effect.
This includes, without limitation:
- confidentiality;
- intellectual property;
- certification restrictions;
- limitation of liability;
- dispute resolution;
- governing law; and
- any accrued rights or obligations.
