21. Photography, Video and Media
Parimukti may photograph, film, or otherwise record Programmes for educational, archival, and promotional purposes.
Unless a participant notifies Parimukti in writing before the Programme begins that they do not wish to appear in marketing materials, the participant grants Parimukti a worldwide, perpetual, royalty-free licence to use photographs, video recordings, and audio recordings in which the participant appears for marketing, educational, editorial, and promotional purposes.
Parimukti will make reasonable efforts to respect written opt-out requests. However, participants acknowledge that it may not always be possible to exclude them from incidental background appearances in group photographs or recordings.
Participants are not entitled to compensation for the authorised use of such media.
22. Intellectual Property
All intellectual property associated with Parimukti Programmes is and remains the exclusive property of Parimukti Yoga and Meditation Private Limited.
This includes, but is not limited to:
- training manuals;
- workbooks;
- presentations;
- videos;
- audio recordings;
- graphics;
- photographs;
- written materials;
- course structures;
- teaching methods;
- exercises;
- branding;
- logos;
- trademarks;
- website content; and
- all other proprietary materials.
Participation in a Programme grants the participant only a limited, personal, non-exclusive, non-transferable licence to use the materials for their own learning.
Participants may not, without prior written permission from Parimukti:
- reproduce;
- copy;
- record;
- livestream;
- photograph training materials where prohibited;
- publish;
- distribute;
- translate;
- adapt;
- create derivative works from;
- sell;
- licence; or
- commercially exploit any Programme materials.
Unauthorised recording of teaching sessions is prohibited unless expressly approved in writing by Parimukti.
23. Certification
Participants who successfully complete the Programme and satisfy Parimukti’s educational and professional requirements may receive a Certificate of Completion or other certification issued by Parimukti.
Attendance alone does not automatically entitle a participant to certification.
Parimukti reserves the right to withhold, defer, or make conditional any certification where, in its reasonable professional judgement, a participant has failed to demonstrate:
- adequate understanding of the material;
- satisfactory practical competence;
- appropriate professional or ethical conduct;
- completion of required assessments; or
- compliance with Programme requirements.
The decision to withhold certification does not entitle the participant to a refund.
24. Use of Certification and the Parimukti Brand
Participants who receive certification may truthfully state that they have completed a Programme or have been certified by Parimukti.
However, certification does not create any employment, partnership, agency, franchise, or representative relationship with Parimukti.
Unless expressly authorised in writing, graduates may not:
- present themselves as official Parimukti trainers;
- represent themselves as acting on behalf of Parimukti;
- use the Parimukti name, logo, branding, manuals, or proprietary training systems to market their own services;
- advertise any programme as a “Parimukti” training, retreat, workshop, or certification.
Any commercial use of the Parimukti name, branding, or intellectual property requires a separate written licence, franchise agreement, or other formal authorisation.
25. Personal Property
Participants remain solely responsible for their own luggage, valuables, money, passports, electronic devices, jewellery, and other personal belongings.
To the fullest extent permitted by applicable law, Parimukti accepts no responsibility for loss, theft, or damage to personal property unless directly caused by Parimukti’s proven negligence.
26. Limitation of Liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
Subject to the above, Parimukti shall not be liable for any indirect, incidental, consequential, special, exemplary, or economic loss arising from participation in a Programme.
This includes, without limitation:
- loss of income;
- loss of profits;
- loss of business opportunity;
- travel disruption;
- accommodation expenses booked independently;
- currency exchange losses;
- bank charges; or
- any other consequential loss.
Where liability cannot legally be excluded, Parimukti’s total liability shall, to the maximum extent permitted by law, be limited to the amount actually paid by the participant to Parimukti for the relevant Programme.
27. Force Majeure
Parimukti shall not be liable for any failure or delay in performing its obligations where such failure or delay results from events beyond its reasonable control.
These events include, but are not limited to:
- natural disasters;
- earthquakes;
- floods;
- fires;
- pandemics;
- epidemics;
- government restrictions;
- visa or border closures;
- acts of war;
- terrorism;
- civil unrest;
- strikes;
- transportation disruption;
- utility failures;
- venue closures; or
- any other event making the Programme impossible, unsafe, or commercially impracticable.
Where reasonably possible, Parimukti will notify participants promptly and offer the remedies set out in the Cancellation & Transfer Policy.
28. Complaints and Dispute Resolution
Participants agree to raise any complaint promptly by emailing info@parimukti.com with full details of the issue.
Before commencing legal proceedings, both parties agree to make a genuine effort to resolve the dispute through good-faith discussions.
Parimukti will endeavour to investigate and respond within thirty (30) days of receiving a written complaint.
If the matter cannot be resolved, either party may pursue any legal remedy available under applicable law.
